Terms of service
These Terms of Service ("Terms") govern your access to and use of https://miggaming.com (the "Site") and any purchase or service you obtain from MIG Gaming, operated by Made For Indigenous Gamers MIG Gaming Cafe ("we," "us," "our"). By accessing the Site or placing an order, you agree to these Terms.
1. Eligibility.
You must be at least 18 years old and able to enter into a legally binding contract to use the Site and place orders.
2. Your account.
If you create an account, you're responsible for keeping your login details confidential and for all activity under your account. Notify us promptly of any unauthorised use.
3. Products, descriptions & pricing.
We take care to describe and price products accurately, but we don't warrant that all content (including images, specifications, and colours) is error-free or current. Prices are in Indian Rupees (INR); applicable taxes (GST) and shipping are shown at or before checkout. We may correct errors and update prices and product information at any time before an order is accepted.
4. Orders & acceptance.
Your order is an offer to purchase. A confirmation email acknowledges receipt but does not constitute acceptance. We may accept or decline any order at our discretion, including where an item is out of stock, priced incorrectly, or where we suspect fraud. If we can't fulfil an accepted order, we'll contact you and refund any amount paid for the affected item.
5. Custom PC builds & compatibility.
For custom or made-to-order builds, you're responsible for confirming your requirements. We'll advise on compatibility to the best of our knowledge, but where you specify particular parts, final responsibility for suitability rests with you. Once assembly or component procurement begins, custom builds are non-cancellable and non-returnable except for defects. Build lead times are estimates and may vary with component availability.
6. Repairs, upgrades & installation services.
For repair, upgrade, and installation services: (a) you confirm you are the owner of the device or authorised to have it serviced; (b) **you are responsible for backing up your data before any service — we are not liable for any loss of data, software, or files** that may occur during repair, upgrade, or installation; (c) we may provide a diagnostic assessment and estimate, and work proceeds on your approval; (d) diagnostic or handling fees may apply; and (e) items not collected within 30 days of service completion may incur storage charges or be dealt with as permitted by law. You are responsible for the legality and licensing of any software you ask us to install.
7. Warranty.
Manufacturer warranties on components are passed through to you; their terms, duration, and claim process are set by the manufacturer, and we'll help coordinate valid claims. We provide a limited warranty on our assembly/labour for pre-built and custom PCs as set out in our Terms and Conditions. Warranties don't cover misuse, accidental or liquid damage, unauthorised modification, tampering with seals, or operation outside manufacturer specifications.
8. Shipping, returns, refunds & cancellations.
Delivery is governed by our Shipping Policy; returns, replacements, refunds, and cancellations are governed by our Return & Replacement Policy and Refund & Cancellation Policy, each of which forms part of these Terms.
9. Intellectual property.
All content on the Site — logos, text, graphics, images, and layouts — is owned by or licensed to Made For Indigenous Gamers MIG Gaming Cafe and is protected by applicable IP laws. You may not copy or use it without our prior written permission. Third-party brand names and trademarks remain the property of their respective owners.
10. Acceptable use.
You agree not to use the Site for any unlawful purpose, to interfere with its operation or security, attempt unauthorised access, scrape or harvest data, or post unlawful, infringing, or harmful content.
11. Third-party links.
The Site may link to third-party websites or services (including payment providers). We're not responsible for their content, policies, or practices.
12. Disclaimers.
The Site and products are provided on an "as available" basis. Except for warranties that cannot be excluded under applicable law and any applicable manufacturer's warranty, we make no additional warranties, express or implied. Gaming hardware should be assembled and used according to manufacturer instructions and safety guidance.
13. Limitation of liability.
To the maximum extent permitted by law, we won't be liable for any indirect, incidental, or consequential loss (including loss of data), and our total liability arising out of or in connection with any order or service will not exceed the amount you paid for it. Nothing here limits liability that cannot be limited under applicable law.
14. Indemnity.
You agree to indemnify us against claims, losses, and expenses arising from your breach of these Terms or misuse of the Site, products, or services.
15. Force majeure.
We're not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, courier disruptions, or government actions.
16. Governing law & jurisdiction.
These Terms are governed by the laws of India. The courts at Chennai, Tamil Nadu shall have exclusive jurisdiction over any dispute, subject to applicable law.
17. Changes.
We may update these Terms at any time. The current version will always be available on this page. Continued use of the Site after changes constitutes acceptance.
